YCS Network Terms and Conditions
Introduction
YCS Network is an online platform designed for collaboration among YCS staff. It has been built to encourage discussion, share knowledge and expertise and to be a safe and inclusive platform for all YCS staff.

General
Please read these Terms and Conditions before using YCS Network. You are responsible for your use of the platform, and any content you provide to the platform, in accordance with the terms and conditions below
YCS Network is intended for use by Youth Cancer Service staff only.
For the purposes of these Terms and Conditions, “Canteen”, “YCS National” “YCS Network,” “us”, “our” and “we” refers to The Australian Organisation For Young People Living With Cancer (ABN 77 052 040 516) (Canteen), as operator of this platform. “You”, “your”, and “user(s)” refers to you, the person using the platform.
We may change part or all of the Terms and Conditions at any time. The most current Terms and Conditions will be updated on YCS Network. Continuing use of the platform indicates acceptance of the Terms and Conditions that are current at that time.

Using the platform
3.1 Registering to use the platform
The YCS Network platform and all its content is not accessible without a user account. All YCS staff will receive an email invitation to register to join the platform, which will include a link to activate their account and create a login and password.
Users are encouraged to choose a strong password to keep the information and content on the platform safe and confidential.
Activation requirements
To activate your account, you will be asked to provide your:
(a) email address and a password
(b) first and last name
(c) YCS jurisdiction and practice group
(d) The year you started working in AYA cancer care.
Some of this information may already be pre-filled for you. You are welcome to edit your information at any time.
3.2 YCS Network rules
We want the YCS Network to be helpful and safe for everyone. When using this platform and chatting with others in the YCS community, we ask that you follow a few rules.
Your responsibilities
You are responsible for:
(a) all your activity on the platform
(b) all the materials you provide on the platform
(c) what you access on the platform, how you interpret or use the platform and any actions you may take as a result of using the platform
(d) not using any information on this platform for any commercial purpose or otherwise (either directly or indirectly) for profit or gain.
Canteen is not responsible for the conduct of the users of YCS Network.
Safety and respect for others
We encourage open and frank discussions that are also polite and courteous. It is important that everyone feels safe to have their say. When using the platform, please respect other people’s opinions, even if they are different to your own. Additionally, we ask that your conduct reflects the professional nature of this platform. Do not share information that is medically inaccurate or biased, or content that is of a personal nature, unless directly related to the work of the YCS.
If you see a post that you believe is offensive, inappropriate or spam, please report it in the platform or via email to [email protected] and we will investigate promptly. This applies to both posts and private messages – please note private messages will only be visible to staff if reported.
Privacy
The content on YCS Network is only accessible after a user has been invited to join the platform and activated their account. Log ins are provided to current YCS staff and affiliated YCS staff upon request.
The platform is designed for collaboration across the YCS locations. You may choose to share your experiences, information, details and content with your colleagues. Please refrain from sharing other people’s information without their permission. Do not post information that may be construed as personal information. The Privacy Act defines personal information' as:
'Information or an opinion about an identified individual, or an individual who is reasonably identifiable: ... whether the information or opinion is recorded in a material form or not.
All efforts should be made to ensure patient confidentiality. Please do not share or post photos or videos of other people unless you have permission to do so.
Appropriate content
Any content that could be considered harmful or identifying personal information for individuals outside of the YCS community (names, place of work, etc.) will be removed. Additionally, posts containing false information may be removed.
If you have any concerns about posts on the platform, please report the post on the platform or contact [email protected] and we will investigate promptly.
YCS National team will monitor the content and will remove posts which do not comply with these Terms and Conditions. Before a post is removed, YCS Network administrators will seek advice from YCS Service Managers to ensure removal of the post is warranted. If your post is removed, we will contact you to explain why.
3.3 Stopping use of YCS Network
You may stop using the platform at any time for any reason. We are able to remove your profile permanently from the platform upon request. Please email us. [email protected]
3.4 Use of material you post or share on the YCS Network platform
You will retain the rights of any original material you post on YCS Network. Canteen will not use, publish, reproduce, transmit, distribute, modify, edit, display, translate, enhance, sublicense, and/or adapt content or any intellectual property rights you may have in the content in any medium and for any purposes.
3.5 Use of materials posted or shared by YCS National on the YCS Network platform
Materials involving YCS staff and developed by YCS National for the platform, including Staff Profiles, Memorable Patient articles and Staff Blog posts, will remain the property of YCS National and may be used in future YCS Newsletters, or the YCS Website. We will seek permission from the featured staff member(s) before sharing outside of the platform.
4. Data
All data associated with the platform remains the property of Canteen Australia. Data is backed up daily and stored in a secure environment in line with the obligations outlined in the Agreement between Canteen Australia and Hivebrite, and the privacy policies described below.

YCS Network is housed on the Hivebrite platform and is underpinned by its privacy policy, drafted in accordance with the requirements of the EU General Data Protection Regulation (“GDPR”) (adopted in Australia in May 2018). GDPR practices ensures that data from members of the YCS community is only used:
To enable us to provide services to you and to communicate with you. This may include Identity, Contact, and Transactional data.
To notify you about any changes such as improvements to our platform that may affect our service or relationship with you.
Where you have consented to receive our e-newsletters. This may include Identity and Contact Data.
For the purpose for which it was originally obtained.

6. Entire agreement
These Terms and Conditions represent the entire agreement between you and YCS National team at Canteen concerning your use and access to YCS Network and the content within the platform. No other term is to be included in these Terms and Conditions except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are expressly excluded.

YCS Network App End User License Agreement
This End User License Agreement (“Agreement”) is between you and YCS Network and governs use of this app made available through the Apple App Store. By installing the YCS Network App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the YCS Network App.
In order to ensure YCS Network provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the “Report as offensive” feature found under each post.
1. Parties
This Agreement is between you and YCS Network only, and not Apple, Inc. (“Apple”). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. YCS Network, not Apple, is solely responsible for the YCS Network App and its content.
2. Privacy
YCS Network may collect and use information about your usage of the YCS Network App, including certain types of information from and about your device. YCS Network may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the YCS Network App.
3. Limited License
YCS Network grants you a limited, non-exclusive, non-transferable, revocable license to use the YCS Network App for your personal, non-commercial purposes. You may only use the YCS Network App on Apple devices that you own or control and as permitted by the App Store Terms of Service.
4. Age Restrictions
By using the YCS Network App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the YCS Network App does not violate any applicable law or regulation. Your access to the YCS Network App may be terminated without warning if YCS Network believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child’s use of the YCS Network App, you agree to be bound by this Agreement in respect to your child’s use of the YCS Network App.
5. Objectionable Content Policy
Content may not be submitted to YCS Network, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sportsbooks, bingo or poker.
6. Warranty
YCS Network disclaims all warranties about the YCS Network App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, YCS Network, not Apple, shall be solely responsible for such warranty.
7. Maintenance and Support
YCS Network does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, YCS Network, not Apple, shall be obligated to furnish any such maintenance or support.
8. Product Claims
YCS Network, not Apple, is responsible for addressing any claims by you relating to the YCS Network App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the YCS Network App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
9. Third-Party Intellectual Property Claims
YCS Network shall not be obligated to indemnify or defend you with respect to any third-party claim arising out or relating to the YCS Network App. To the extent YCS Network is required to provide indemnification by applicable law, YCS Network, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the YCS Network App or your use of it infringes any third party intellectual property right.
